Member Terms of Use

1. Agreement to Terms

By creating an account, completing onboarding, or otherwise using ClearGym as a gym member, you agree to be bound by these Member Terms of Use ("Terms"). If you do not agree, you should not use the platform.

These Terms govern your use of ClearGym as a member of a gym or fitness facility that uses ClearGym to manage its operations. Your relationship with the gym itself (including membership fees, cancellation policies, and facility rules) is between you and the gym and is not covered by these Terms.

2. Your Account

2.1 Registration

Your account is created when your gym invites you to join ClearGym. You are responsible for setting a secure password and keeping your login credentials confidential.

2.2 Accurate Information

You agree to provide accurate and up-to-date personal information, including contact details, emergency contact information, and any health or medical information requested during onboarding. Providing inaccurate health information may affect the safety and suitability of any training plans or activities.

2.3 Account Security

You are responsible for all activity that occurs under your account. If you become aware of any unauthorised access, please notify your gym and contact us immediately.

3. How We Use Your Information

Your personal data is processed in accordance with our Privacy Policy. In summary:

• Your gym is the data controller for your personal information. They determine why and how your data is processed.
• ClearGym acts as a data processor, handling your data on the gym's behalf to provide the platform.
• Sensitive health data (PAR-Q responses, medical conditions, injuries, medications, and allergies) is encrypted at rest using AES-256-CBC encryption.
• Payment information for gym memberships is processed securely by Stripe. ClearGym does not store your full card details.

4. AI-Assisted Training Plans

ClearGym provides your gym's trainers with the option to generate personalised training plans using an AI-assisted feature. If your trainer uses this feature, relevant profile information you have provided — such as your fitness experience level, available equipment, and any health considerations you have disclosed — may be sent to Google's Gemini API to generate the plan.

This data is processed solely to produce the training plan for that specific request. It is not retained by Google after the request is complete, and it is not used to train, fine-tune, or improve any AI models.

5. Membership Payments

If your gym collects membership fees through ClearGym, payments are processed by Stripe on behalf of your gym. By subscribing to a membership:

• You authorise Stripe to charge your chosen payment method on a recurring basis as set by your gym
• Membership pricing, billing frequency, and cancellation terms are determined by your gym
• Refund requests and billing disputes should be directed to your gym in the first instance

Your use of Stripe's payment services is subject to Stripe's Terms of Service.

6. Acceptable Use

You agree not to:

• Share your account credentials with others
• Provide false or misleading information
• Attempt to access other members' data or areas of the platform you are not authorised to use
• Use the platform for any unlawful purpose

7. Your Data Rights

Under GDPR and UK data protection law, you have the right to:

• Access the personal data held about you
• Request correction of inaccurate data
• Request deletion of your data
• Object to or restrict processing of your data
• Receive your data in a portable format

8. Disclaimers

8.1 Not Medical Advice

Training plans and fitness content provided through ClearGym (including AI-generated plans) are for informational purposes only and do not constitute medical advice. Always consult a qualified healthcare professional before starting any new exercise programme, particularly if you have disclosed medical conditions or injuries.

8.2 Service Availability

The platform is provided "as is". We do not guarantee uninterrupted or error-free access. Your gym membership and access to gym facilities are not affected by any ClearGym downtime.

8.3 Limitation of Liability

To the maximum extent permitted by law, ClearGym shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including any reliance on AI-generated training plans.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the platform. Continued use of ClearGym after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
